RENTAL/LETTING OF APARTMENTS

"The Bay" is a Residential complex and short-term holiday lets are not allowed other than to family.  Specifically, the running of commercial letting businesses and the advertising of apartments to let is not allowed.  From 2019 the Decree/Law has been approved to modify the Horizontal Property Law by introducing a new Section 12 in Article 17. (Spanish Version can be found here)

 

Long-term lets where tenants can become a member of the Community are accepted.  A guide as to a break point between holiday letting and long term letting is that the minimum let should be 1 month or more and that a formal contract should be in place.

Confirmation of the change to the Statutes for Amarilla Bay Phase 1

Hi Peter

I am following up with the notary to write into the statutes that there are no tourist rentals in the complex. The notary has added it to the statutes of the community under article 20  but has added more wording to it. It says:

 

Artículo 20. Prohibición de los alquileres vacacionales/turísticos.

Los alquileres vacacionales quedan limitados a aquellos que a fecha 16 de noviembre de 2019 hayan obtenido una licencia oficial para ello. Cualquier comunero que no disponga de licencia oficial anterior a dicha fecha le está expresamente prohibido dedicar su vivienda al alquiler vacacional a cuyos efectos, en caso de querer dedicar su vivienda a dichos arrendamientos vacacionales, deberá formular una solicitud a los órganos representativos de la Comunidad de Propietarios para que se incluya tal solicitud en el orden del día de la siguiente Junta. A dicha solicitud deberá acompañar un proyecto que explique cómo minimizar el impacto, tanto de ruidos, limpieza, seguridad y cumplimiento de las normas comunitarias por parte de sus arrendatarios vacacionales. La mera solicitud no faculta para la puesta en marcha, debiendo esperar a obtener la autorización por la Junta de Propietarios quien decidirá mediante mayoría de 3/5 partes de votos y cuota si le autoriza o no para ello, siempre y cuando sus colindantes inmediatos, pared con pared, voten a favor de dicha solicitud o se abstengan, pudiendo vetar dicho alquiler con su solo voto en contra, independientemente de la mayoría obtenida. En ningún caso podrán otorgarse dichas autorizaciones a más de 10% de las unidades de vivienda para preservar el carácter residencial del complejo.

Article 20. Prohibition of vacation / tourist rentals.

Holiday rentals are limited to those who as of November 16, 2019 have obtained an official license for it. Any community owner who does not have an official license prior to that date is expressly prohibited from dedicating their apartment to vacation rental, for which purpose, should they wish to dedicate their apartment to such vacation rentals, they must make a request to the committee of the Community of Owners so that such request is included in the agenda of the next Meeting. To this request the owner must accompany a project that explains how to minimize the impact, both of noise, cleaning, security and compliance with community regulations by his/her vacation renters. The mere application does not authorize the implementation, and must wait to obtain the authorization by the AGM who will decide by a majority of 3/5 parts of votes and quota whether or not to authorize it, as long as its immediate neighbors, wall to wall, vote in favor of said request or abstain, being able to veto said rental with their only vote against, regardless of the majority obtained. In no case may such authorizations be granted to more than 10% of the housing units to preserve the residential character of the complex.
